Hayley Bundey, a specialist TOLATA solicitor, has recently successfully settled another TOLATA claim.
When Hayley presented the case, the Defendant refused to negotiate. She therefore issued and served court proceedings. This resulted in the Defendant recognising the strong merits of the claim. Sensibly they agreed to attend a mediation at which they made our client an acceptable offer.
TOLATA, or the Trusts of Land and Appointment of Trustees Act, regulates disputes over property ownership. It gives the courts wide powers to determine how property should be dealt with. Judges can make an order for sale, rule whether a trustee or beneficiary should be entitled to purchase a property, and determine whether someone has the right to occupy a family home.
Our client in this latest case was vulnerable and it took immense strength for them to bring the claim. The positive outcome at mediation has been life-changing for them and a very well deserved reward for holding their nerve and trusting Hayley to guide them through the process with her full support and encouragement along the way.
Hayley acted on a conditional fee agreement basis (No Win, No Fee) in this instance but we also offer other forms of funding for TOLATA claims.
TOLATA claims often involve difficult emotive factual backgrounds which can make it challenging for claimants to find the strength to drag up that history in order to pursue the case. Hayley prides herself on helping vulnerable clients achieve justice. She provides that extra helping hand to enable them to pursue their claim and is always ready to support her clients in doing all she can to make the process as manageable as possible for them to get the outcome they deserve.
