If you are thinking about bringing a claim under the Inheritance (Provision for Family and Dependants Act) 1975, then here are a few of the issues that will need to be considered.
Time limits
There are strict time limits for bringing an inheritance claim. It is therefore important that you act quickly in obtaining specialist legal advice.
Inheritance claims must be brought within six months of the date of the Grant of Probate or Grant of Letters of Administration.
While it is best to avoid delay, late claims are sometimes permitted, so it is worth checking with us even if you are out of time.
Who can make an Inheritance Act claim?
To be able to make a claim under the Inheritance Act, you must belong to at least one of the following groups:
- A spouse or civil partner of the deceased;
- A former spouse or civil partner of the deceased, who has not remarried;
- An unmarried partner of the deceased who lived with them as husband or wife for two years before they died;

- Someone who was treated by the deceased as a child of the family;
- Someone who was financially maintained by the deceased.
