Inheritance solicitor, Hayley Bundey, has won another Inheritance Act claim at mediation. On this occasion she was acting on behalf of her client against their mother’s intestate estate.
It is not uncommon for one sibling to do more of the caring for a parent than others. Sometimes a sibling will even move in with the parent to help with their care. And in some circumstances they will do so having relied upon promises of inheritance. But what happens when the parent fails to honour those promises?
This is what happened in Hayley’s case. Her client was made promises by her mother, but the mother failed to make a will honouring them.
The out of court settlement Hayley reached at mediation was particularly challenging due to the number of siblings involved and the fact that the majority were not represented at mediation. However, she ensured that her client received a 6 figure sum, with their legal costs covered in full. Her client is now able to move on with their life and grieve the loss of their mother, which had been put on hold for so long.
As with most mediations in this field, they can be very emotive, dragging up events from many years ago. But the benefit of resolving inheritance disputes this way is that it avoids airing the family’s’ dirty laundry’ in court, as well as saving the costs, time and stress of taking the case to a trial; at a time when everyone is also grieving and needing to press on with the administration of an estate.
Hayley acted on a no win, no fee basis in this case, though we also offer various other forms of funding.
